1. Who we are and what this covers

MonitorFree ("we", "us", "our"), a product operated by Hermon Industries, provides a subscription server-monitoring service that lets you observe CPU, memory, disk, network, and related metrics for your own servers ("VPS" or "servers"), receive alerts, and trigger a limited set of whitelisted remote actions through lightweight agents you install on those servers. These Terms & Conditions govern your use of the MonitorFree website, dashboard application, and agents (collectively, the "Service"). By creating an account or using the Service, you agree to these terms.

2. Account eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a MonitorFree account. You are responsible for the accuracy of the information you provide at signup and for maintaining the confidentiality of your account credentials and any API keys issued to you. You are responsible for all activity that occurs under your account, including actions taken by anyone you invite to a shared team.

3. The Service

MonitorFree is provided on a "as available" basis. Agents installed on your servers report metrics to our backend on a periodic interval; alerting, remote actions, SSH terminal access, and SFTP browsing are provided subject to your plan tier. We may add, change, or remove features over time, and we'll make reasonable efforts to communicate material changes that affect how you use the Service.

4. Subscription billing

Paid plans are billed on a recurring basis (monthly or as otherwise offered at checkout) through our payment processor, Razorpay. Prices are shown in US Dollars (USD).

  • Auto-renewal. Subscriptions renew automatically at the end of each billing period using your saved payment method, unless cancelled beforehand.
  • Plan changes. You may upgrade, downgrade, or change your plan at any time from your account's billing page; changes take effect according to the proration or effective-date behavior shown at the time of the change.
  • Add-ons. Additional server capacity ("add-on hosts") may be purchased separately and are billed alongside your base plan.
  • Current pricing. Current plan tiers, included server counts, and features are shown on our pricing page and are subject to change; we'll do our best to notify active subscribers of material price changes before they take effect on renewal.

5. Acceptable use

You agree to use MonitorFree only for monitoring and managing servers you own or are authorized to administer. You will not use the Service to:

  • Monitor or attempt to access servers or infrastructure you do not own or have explicit authorization to manage;
  • Attempt to circumvent the whitelisted, confirm-gated nature of remote actions, or use the Service to perform actions outside that whitelist;
  • Interfere with or disrupt the integrity or performance of the Service, its agents, or other customers' use of it;
  • Use the Service for any unlawful purpose, or to store or transmit malicious code;
  • Attempt to reverse-engineer, resell, or white-label the Service without our written consent.

Remote actions available through MonitorFree (such as restarting a service, killing a process, tailing a log, or rebooting a server) are limited to a fixed, whitelisted set of operations and require explicit confirmation before execution. Every requested and completed action is logged to an audit trail associated with your account.

6. Your data and credentials

Where you use SSH terminal or SFTP features, you provide server credentials that we store encrypted at rest solely to facilitate that connection on your behalf. You remain responsible for the security posture of your own servers, including keeping their operating systems and software patched. See our Privacy Policy for details on how we handle your data.

7. Limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. MonitorFree is a monitoring and alerting aid, not a guarantee against downtime, data loss, or security incidents on your infrastructure. To the maximum extent permitted by applicable law, MonitorFree, operated by Hermon Industries, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of, or inability to use, the Service. Our total aggregate liability for any claim arising from these terms or the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Termination

You may cancel your subscription at any time from your account's billing page; cancellation stops future renewal charges (see our Refund Policy for how this differs from a refund of past charges). We may suspend or terminate your account if you violate these terms, misuse the Service, fail to pay applicable fees, or if required to do so by law. Upon termination, your right to access the Service ends; we handle any data retained after termination as described in our Privacy Policy.

9. Governing law

These Terms & Conditions are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the Service will be subject to the exclusive jurisdiction of the courts located in India.

10. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by an updated "Last updated" date on this page. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
